Mystic dwarves' judge loses job
A judge in the Philippines who claimed to have psychic powers and communicate with imaginary "dwarf friends" has lost his appeal to keep his job.
Court officials said on Friday that the Supreme Court was not convinced of the judge's mental state and rejected his appeal.
Florentino Floro, who presided in a suburban Manila court, was sacked on March 31 on "administrative grounds" after he failed a psychiatric test ordered by the Supreme Court.
The judge, who started his court sessions with a reading from the Bible's Book of Revelation, lodged an instant appeal.
Floro was also understood to have claimed supernatural abilities, the ability to read the future and to have held "healing sessions" in his chambers. He also apparently claimed to have been seen by several people in two places at the same time.
The rule of law
The final ruling, written on August 11, said "judges are expected to be guided by the rule of law and to resolve cases before them with judicial detachment" to ensure that the public maintained its confidence in the judicial process.
"The psychological finding of mental unfitness, when taken together with Judge Floro's claimed dalliance with 'dwarves' poses a serious challenge to such required judicial detachment and impartiality," the ruling said.
This would "eventually erode the public's acceptance of the judiciary as the rational guardian of the law, if not make it an object of ridicule.
"His insistence on the existence of 'dwarves', among other beliefs, conflicts with the prevailing expectations concerning judicial behaviour and manifests a mental state that should lay to rest any doubts about his valid removal from office for lack of the judicial temperament required of all those in the bench."

When I was interviewed by Sam Chambers for HK Standard, he said that his remaining ambition in his life is to write a book.
It never crossed my mind that I would write a book since I do not read non-legal books.
In 1972, Ateneo de Manila University assigned us per Ms. Nunes in English I, William Faulkner's As I lay dying, which I read for one month.
I wrote this book for almost 4 years minus about 2 years I edited Wikipedia. So, I desire your offspring to remember that there is a Judge who was removed for consulting dwarves. Maybe your children and younger generation would readily understand how painful it is to loose a job amid my honors and bar placing, where worked so hard for.
First, let me stress that jury nullification has no application here in Philippines, since a) there is no trial by jury under our Rules of Court (derived from Rule of Federal Service of CA, USA), since only judges and justices render judgments, not verdicts. Judges hear the case and the Clerk promulgates or releases his decision based on both law and facts, as our 1987 Constitution requires (also partly copied from USA 5th Amendment); and b) the law on double jeopardy prohibits an appeal from an acquittal decision. There is only one case in Philippine history, where the new government of Cory Aquino in 1987 that toppled the Marcos regime, made a mockery of justice, when the Sandiganbayan, per Justice Regino C. Hermosisma, Jr., reversed the acquittal decision of the Marcos Sandiganbayan Justice Manuel Pamaran who acquitted all of the accused who were accused of killing Benigno Aquino, Jr. In the name of new trial, the Cory government re-opened the case and ordered Justice Hermosisima, Jr. to convict these innocent accused. The prize? Justice Hermosisima, Jr. was promoted to the Supreme Court, and later was appointed 4x JBC Member from 1997 to 2012. The result, curse, karma and spell upon the judiciary and Cory family. Cory Aquino and Vice President Laurel both suffered and die of cancer, while Kris Aquino is fighter for her dear love life as Pinoy prostitute.
Second, let me state that human nature and frailty, cannot, in any manner, change the attitude, demeanor and greed of Justice, magistrates, jurists, prosecutors and defense lawyers. In Orange County, Justice William W. Bedsworth wrote on this in Judges and Dwarves don't mix.

The jury system aims for perfection of a truly imperfect court system and world of hypocrisy. But at the very least, it is about 60% less perverse than our most corrupt court system here in crab mentality Philippines. If jurists are appointed here, then, they would join the honorable thieves' take on the economic graft and corruption pie or cake.
We have the arbitration system here which was recently approved, but it never solved any corruption case. The judgments remain the same: sold for cash to the highest bidder.
Third, legal niceties being the art of the day, I state with gusto, that, jurors must only decide the facts, as arbitrators or trial commissioners, would, and leave to the judge the inherent right to decide the case based on the submitted and voted by juror's facts and his application of the law of the case, based on tons of considerations, like, the judge being offered half of the property. The sad thing is, criminal acquittals are not appealable by certiorari or ordinary appeal under civilized constitutions because of double jeopardy.
IN FINE, the dwarves would prefer the Juez de Cuchillo or Judge using a knife, or rather a 1950 Winchester collection gun to shoot to annihilate crab mentality Filipino e forum members and justices, burning them in Hades via curse, karma and spell.
